Introduction
Welcome to Diagonals Literary Festival!
These are our Terms & Conditions for use of this Website, the Content and Services.
By using this Website, the Content or the Services in any way, you agree to these Terms and Conditions and agree to be bound by them, regardless of the way you access the Website, use the Content or Services.
BY USING THE WEBSITE, CONTENT OR SERVICES YOU AGREE TO WAIVE YOUR RIGHTS TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AND YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND DIAGONALS LITERARY FESTIVAL WILL BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. SEE Class Action Waiver.
1. Age Limitation
If you are considered a minor in your country, by using the Website you confirm and represent that you have your parent’s or legal guardian’s consent to use any of our Services and that they have read and approved of these Terms.
Publications on The Festival labelled with “Mature/Explicit Content” are strictly intended for persons legally considered to be adults. By reading publications with the aforementioned labels you confirm that you are legally considered an adult in your country or region of residence.
Age Limitation for Making Submissions
Only persons of or above the age of sixteen (16) are allowed to submit and pay the submission fee on diagonalsliteraryfestival.com. If you are under this age and make a submission, you confirm that you have your parent’s or legal guardian’s consent to do so.
If you are a parent or legal guardian of a minor in your country, by allowing your child to use the Website or any of our Services, you are subject to the Terms of this Agreement and responsible for the child’s activity on the Website. Further, you agree to fully indemnify and hold harmless the Company if the minor breaches any of these Terms.
If you are below the legal age required by the laws and regulations of your country or region of residence for you to be able to access the Website, use any of the Content or Services or consent to these Terms – with or without the approval of your parent or legal guardian – you may not do so at any time or in any manner.
2. Account Registration
2.1. Creating an account on this Site is not necessary for using any of the Services, except for writing and posting comments under publications.
By registering on the Site, you agree that:
1. your account and password are personal to you and may not be used by anyone else for any reason;
2. you will not do anything which would assist anyone who is not a registered user to gain access to the Site;
3. you will not create accounts for the purpose of abusing the functionality of the Site and the Services or the experience of other users of the Site;
4. you will not seek to pass yourself as another person or user;
5. you will be responsible for the confidentiality and security of the account information you provide (including your account password, which no authorized representative of Diagonals Literary Festival will ever ask you to reveal) as well as all activities that occur under your account;
2.2. If you create an account and choose to write and post comments on the Site, you agree to the Site’s Terms and that you accept and will unconditionally follow all rules for commenting on the Site as specified in the next point.
2.3. Rules for commenting on the Site
The purpose of allowing people to comment on the Site is to facilitate a welcoming space for intelligent, critical, valuable and respectful discussion.
Debate and disagreement are important. We respect that and encourage people to express their own views.
However, we do not accept and will not tolerate certain behavior in the comments section of any publication which appears on Diagonals Literary Festival. The Festival reserves the right to, without being liable and without the necessity to provide any prior notice or receive any consent from anybody or anything, terminate the accounts and delete the comments of users engaging in the following activities. These are user comments that contain:
1. themes, including but not limited to, ageism, racism, sexism, xenophobia, homophobia, transphobia;
1.1 any kind of hate speech or personal insults or attacks directed towards, including but not limited to, the author(s) of the work under which a comment appears as well as other users on the Site;
1.2 any material that abuses, harasses, bullies, intimidates, defiles or disparages an individual on or through the Services;
2. spamming;
3. misleading and/or malicious links posted with the intention (conscious or not) to hurt the Site, its functionality, any of the Services or other users of the Site;
4. anything which may put us in legal jeopardy;
5. anything which may violate our Terms and Conditions;
Comments which have nothing to do with the topic or related topics of the publication under which they appear will be removed.
2.4. In order to protect yourself and your account, you are advised to periodically reset your password.
If you become aware of any known or suspected unauthorized use(s) of your account, breach of security, including loss, theft or unauthorized disclosure of your password, please notify us.
2.5. Everything you do on this Site is your own responsibility. Any fraudulent, abusive or otherwise illegal activity or activity that violates these terms and conditions or other applicable terms and conditions may result in the termination of your account and we may refer you to the relevant law enforcement authorities.
2.6. If a dispute between participants on this Website or different users arise, you agree that Diagonals Literary Festival is under no obligation to be involved.
In the event that you have a dispute with one or more other users, you release Diagonals Literary Festival its employees and owner from claims, demands, and damages of any kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or our Services.
2.7. By registering, you also agree to receive emails from us to the email you have provided to us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form.
3. Using the Website
By using this Site and any of the Services, you agree that your use is and will be in compliance with any local, state, national or international laws, rules, regulations, codes of practices, guidelines or any other requirements of regulatory authorities.
Your use of the Site, Content and Services is for your own personal and non-commercial use only.
Your use of the Site, Content or Services must be done in such a way which does not, and will not, harm, without limitation, the Site, the Content, the Services, us or any copyrighted material which appears on the Site.
You also agree that you will not attempt (or authorize, encourage, instruct, support, promote or enable someone’s attempt) to circumvent, reverse engineer, decrypt, alter, damage or interfere with the Site, the Content or the Services in any way or make any unauthorized use of them for any reason.
Without the prior written permission from an authorized representative of Diagonals Literary Festival, without limitation, you shall not (knowingly or negligently, directly or indirectly):
1. access or use any part of the Site, Content or Services in any way in which you do not have permission or authorization to access or use it;
2. use or facilitate the use of any robots, bots, spiders, scrapers, crawlers, scripts, service, software, any manual or automatic program, tool, device, service, process, method or any automated means designed, without limitation, to data mine, scrape, collect, gather, compile, cache, archive, harvest, index, extract or republish the Content, data or information from the Services, except for inclusion in a search engine;
3. use the Site, Content or Services for, without limitation, the creation, training, development, fine tuning or operation of, without limitation, any software program, algorithm, model, machine or artificial intelligence system; for any text or data aggregation, analysis or mining purposes;
4. use services, software or any manual or automatic device, tool or process designed to circumvent any restriction, condition or technological measure that controls access to the Services in any way, including overriding any security feature, bypassing or circumventing any access controls or use limits of the Services or failing to abide by exclusionary protocols such as the robots.txt or the Automated Content Access protocol;
Diagonals Literary Festival’s robots.txt notice does not, and shall not, constitute Diagonals Literary Festival’s permission or consent for the purposes of these Terms and Conditions. These Terms and Conditions shall prevail in all respects over our robots.txt notice.
5. without limitation, use any software, process, device, tool or any means, manual or automatic or otherwise take any action to, without limitation, interrupt, obstruct, stop, disable and/or harm the normal functioning, availability or appearance of the Site, Content or Services or any part of them;
6. perform data or text mining activities under Article 4 of the EU Directive on Copyright and related rights in the Digital Single Market as well as similar reserved rights in other jurisdictions;
7. state, represent or imply any affiliation, association or connection between any person or entity, including, without limitation, you, your company, your site, content or services with Diagonals Literary Festival, us, the Site, Content or Services if there is not any;
8. impersonate the Website or Services in any way and for any reason, including but not limited to, deceive, defraud or profit from our Website, Content or Services.
Engaging in a prohibited use of the Site, Content or Services may result in civil, criminal and/or administrative penalties, fines or sanctions against the user or those assisting the user.
4. Submitting Content to the Festival and Publication
The only official and legitimate way to submit your work to the festival which guarantees that your work is going to be processed by us is by using one of the official submission forms found on www.diagonalsliteraryfestival.com. See Submission Forms & Guidelines.
By submitting content to the Festival on diagonalsliteraryfestival.com, you agree that:
1. you are the copyright owner of the content you submit or if you are not the copyright owner of the whole or a portion of the content, you possess the necessary permission that authorizes you to use it and submit it;
2. you grant us exclusive permission to publish and host the content that you or a person authorized by you have included in one of the official submission forms only found on and submitted on www.diagonalsliteraryfestival.com.
3. you grant us exclusive permission to use portions of the submitted content on our social media channels, marketing emails and other places for promotional purposes;
4. that you (or any individual or entity) shall not receive a refund, full or partial, of the submission fee for any reason and under any circumstances, including but not limited to, whether the content you (or any individual or entity) have submitted is approved for publication and published on our Website or not.
5. your submission complies with and meets the specified parameters set in the official form, including but not limited to, the word count of your main text.
5.1 If the word count of your main text exceeds the limit posed by the form you have submitted it with, you agree that in order for your submission to be processed, you will have to pay for a correctional fee (which is priced at USD 5.99) by submitting the name of your work and the name which you have chosen to be credited with exactly as they appear on the original submission form. To do this, a correctional form will be provided specifically to you (or an authorized representative to you) by an authorized individual of the Festival.
5.2 If the word count of your work is less than the minimum word count of the form with which you have submitted it, your submission will be normally processed, but you agree that you shall not receive a refund, full or partial, at any time, for any reason and under any circumstances.
6. your work does not necessarily has to be published if it (a) does not meet our quality standards, (b) is inappropriate for publication on the Festival or (c) for any other reason;
7. upon publication, the Content shall remain on the Site until (a) the Festival or its respective copyright owner decides to have it removed (for any reason), (b) if it, in any way, breaches the rights of another copyright owner, (c) if it, at any point in time, poses, without limitation, legal, financial, physical or any other kinds or risks to us, our Site, Content or Services;
8. your work and any other information you provide is in the English language.
While we don’t require any specific style of English to be used, the text of your work must be readable and comprehensible by an English speaker, regardless of their country of residence. The text can still contain unknown or entirely made-up words or phrases or foreign words and phrases, but the overall language of the work has to be English.
This does not apply, for example, to dialogue where different accents and jargons can be used.
9. your text is clear from unintentional grammatical and spelling errors.
While a few typos can be acceptable – and easily corrected – frequent unintentional grammatical or spelling errors may result in your work not being accepted for publication.
Not to be confused with intentional errors (of any kind), which are permitted.
What we do not publish
While we publish all sorts of different writing in different categories, there are select things that we do not publish and that you should not submit. These include, without limitation:
1. Writing of any kind that is intended for young children below or around the age of ten;
2. Summaries or descriptions of stories, books or other works;
3. News;
4. Writing understood by and specific only to a dedicated sphere, for example, without limitation, legal writing, religious writing, technical writing;
5. Hateful, inflammatory, derogatory or harmful material of any kind, including but not limited to religious or political writing intended to (directly or indirectly) radicalize or incite violence of any kind against any (specific or not) individual, group, company or entity.
In case you submit any of these, you agree that your submission will not be processed or published by us and that you will not receive a refund of the submission fee and that you are not going to dispute this or hold us liable.
It should not be confused that while any of the aforementioned may not be submitted as stand-alone works, any of them can be part of a fiction work or, for the purpose of reporting or analysis, part of a non-fiction work.
This shall not be confused with censorship. Diagonals Literary Festival values and adheres to the principals and ideals of freedom of expression and therefore does not impose censorship rules on the content which is submitted or that which appears on the website.
If your content is removed from the Festival
If your content is removed from the Festival, it may or it may not be possible to appear on it again. This depends on whether it was your (or an authorized individual or entity’s) choice to have it removed or not.
If it wasn’t your choice, then you may not have this particular content back on the Festival until further notice or until it complies with all the provisions expressed in point number four above. If it does, you may resubmit it and pay the particular submission fee that applies to it. Note that this alone does not necessarily mean that it will definitely be approved for publication.
If it was your choice to have your (or an authorized person or entity’s) choice to have your content removed, then you may have it back again on the Festival by resubmitting it and paying the specified submission fee. However, this does not necessarily guarantee that it will definitely be approved for publication, especially if its contents have been significantly modified.
If you submit any material of any kind anywhere outside www.diagonalsliteraryfestival.com, you agree that you shall not hold Diagonals Literary Festival liable for any damages of any kind or size caused to you, someone else or an entity. For more infromation, see Limitation of Liability.
5. Author and User Content Copyright
All Content that appears on the Festival is copyrighted property of its respective owner(s).
When your work (or comment or any information you upload) is published on our Website, its original copyright owner(s) do not change. We do not and will not claim to own it.
Diagonal Literary Festival respects the intellectual property of others, and requires that our users do the same. You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. Diagonal Literary Festival has the right to prohibit infringers from using our Website.
If you believe that your copyright has been violated by a publication made on our Festival, contact us providing the following information:
1. identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
2. identification of the claimed infringing material and information reasonably sufficient to permit us to locate the material on our Website (providing the URL(s) of the claimed infringing material satisfies this requirement);
3. a valid email address at which we can contact you;
4. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
5. a statement by you, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf;
6. your physical or electronic signature.

You acknowledge that if you fail to comply with all the requirements of this section, your DMCA notice may not be valid.
Upon receipt of a Notification of Copyright Infringement from a copyright owner that contains the required information described in (1) through (6) above, the Festival will notify the user, if known, of the alleged infringement and remove or disable access to the material that is alleged to be infringing. No personal user information is shared with the copyright owner unless required by law.
If the Festival receives more than one Notice of Copyright Infringement concerning a user, the user may be deemed a “repeat copyright infringer.” The Festival reserves the right to terminate the account(s) of “repeat copyright infringers.”
Procedure to File a DMCA Counter-Claim
If you have received a notice of copyright infringement and you believe that a copyright holder has accused you in error, you may file a DMCA Counter-Claim with Diagonals Literary Festival.
To be effective, a Counter-Claim must be a written communication provided to contact@diagonalsliteraryfestival.com and must include the following information:
1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
2. A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
3. The user’s name and email address and a statement that the user consents to the jurisdiction of Federal District Court for the judicial district in which their physical address is located, or if the user’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the user will accept service of process from the person who provided notification or an agent of such person;
4. A physical or electronic signature of the user.
Upon receipt of a DMCA Counter-Claim, Diagonals Literary Festival will provide the complaining party with a copy of the DMCA Counter-Claim. When the Festival receives a Counter-Claim that meets the requirements of the DMCA, The Festival will process the Counter-Claim in accordance with the requirements of the DMCA.
Misrepresentations of copyright infringement can result in liability for monetary damages. You may want to consult an attorney before taking any action pursuant to the DMCA.
6. Terms of Sale
This section concerns purchasing items from the Diagonals Store through www.diagonalsliteraryfestival.com.
Purchasing
The only legal and authorized way to purchase our original products is through www.diagonalsliteraryfestival.com.
For the apparel we sell on our website, we use Printify, a company which employs print-on-demand providers. We encourage you to familiarize yourself with their terms and conditions and privacy policy as we are not responsible for them.
You may see advertisement of our products on our website, search engines or social media platforms which may include weblinks. Clicking on a link, it will always lead you to our website. Any link which leads to other websites has not been published by us. It is misleading and designed to steal your money or data. We recommend you immediately leave this website. It is much appreciated, if you report such a website to us should you come across it.
We may provide you with coupons which are to be used only on our website and are valid only for the provided specified amount of time. We are not responsible for incorrectly entered or expired coupons and for any damages caused to you or anybody else as a result of this.
You may not use any mechanism, software, system, technique—or anything else—to change our products or their prices, make them unavailable or obstruct in any way or for any reason the ordering process.
By placing an order on our website, you agree your bank account to be charged the amount of money needed for the processing and fulfillment of your order. (This excludes any import taxes which your country may impose on your package. See “Shipping” below.)
Shipping
You agree that you as a customer are responsible for the shipping costs as well as any import taxes your country may impose on the item(s) you order from us. You further agree that should you request a return, these costs will not be refunded to you.
Providing a correct delivery address and picking up your package when it arrives is your sole responsibility.
In case you provide an incorrect delivery address or you fail to pick up your package when it arrives, you agree that you will not hold us responsible for any damages caused to you. In such a case, you may contact us to request that the package be shipped to you again (if this is possible; you will be responsible for the shipping costs or import taxes) or request a refund.
Returns and Replacement
You have the right to return a product you have purchased from us within fourteen days after you receive your package.
If you want to return an item, it must not have visible signs of use. You will be responsible for the return shipping costs and any applicable import taxes.
If the item you have returned has visible signs of use and/or if you have not covered the return shipping costs and import taxes, you agree that we may refuse to accept your item and a refund will not be issued to you.
If you are eligible to request a return and refund and choose to do so, it is your responsibility to provide a valid bank account number to which the sum you have paid will be refunded.
The refunded sum will be only that which you have paid for the products, excluding any shipping costs and import taxes imposed by your country. If any discount was applied to your order, the refunded sum will be the discounted sum which you have paid and not the original cost of the product(s).
A refund will be issued only once. The festival is not responsible for any damages caused to you, somebody else or something else as a result of you, somebody else or something else providing an incorrect or invalid bank account number or for any delays or damages caused by third-party payment-processing software, your bank or for any other occurrence beyond our control.
After fourteen days pass, you agree that you will no longer be able to return a product you have purchased from us.
You agree that you will not be eligible for a return or refund of one or more of our products (or such products which look deceivably like ours) which you have purchased from a third party (e.g., from another website or directly from another individual). The Festival is not responsible, under any circumstances, for resold products or any damages caused to anybody from their purchase.
You can request a refund or a replacement (within fourteen days counting from the day you receive your package) in case the product you have ordered from us can reasonably be proved to be “defect.”
However, if the product has become defect because of your handling of it, it is not eligible for a refund or replacement at any time.
Copyright
The products we sell are copyright property of Diagonals Literary Festival.
Without the explicit written permission of an authorized representative of the Festival, you may not copy, make, reproduce, sell, distribute or give away unauthorized copies of our products or designs for any purpose.
Unauthorized reproduction or distribution of intellectual property are against the law. If it comes to our attention that you engage in one or more of the aforementioned activities, we will use the appropriate legal measures to defend our copyright property.
Data Collection
The data we collect from you is that which you provide when you make your purchase and is used solely to fulfill your order.
Any sensitive data you provide, e.g. credit/debit card information, remains confidential and encrypted (i.e., we and anybody else do not have access to it) and is protected by top payment processing security mechanisms.
By placing an order on our website, you agree to these terms of sale.

The festival’s name (Diagonals Literary Festival), any part of Diagonals Literary Festival’s website design, URLs, metadata, patents, trade secrets, graphics, slogans, the Diagonals logo are trademarks, trademarks or trade dress property of DIAGONAL 9 EOOD and are protected under international copyright laws.
You may not copy, reproduce or sell them in any way and for any reason and they may not be used in connection with any individual, company, product or service without the explicit written permission of an authorized representative of Diagonals Literary Festival.
All other trademarks and designs that may appear on this website are intellectual property of their respective owners and the Festival assumes no legal responsibility for them and is not to be held liable in any way should a legal dispute arise.

9. Limitation of Liability

We assume no responsibility and you agree to not hold us liable for any information you reveal to other incorrect or fraudulent emails, messages, software, apps and/or websites or to any other individuals, companies or entities.
We assume no responsibility, shall not be held liable and shall not provide a refund to you or any person or entity for any reason and under any circumstances should you pay any sum of money for any of our Content or Services to any other individual, company or legal entity, be it digitally or physically.
The written material the Festival publishes is provided for you to read only.
You may not, without limitation, copy it, publish it, perform it in any way, profit from it in any way, use it, without limitation, for any machine learning, software creation or any artificial intelligence learning or use it for any purpose which violates the intellectual property rights of its owner(s) as well as the terms and policies of Diagonals Literary Festival.

Diagonals Literary Festival assumes no responsibility or liability arising from the content of the Site nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger or inaccuracy contained in any information within the Sites or accessed through the Site. The Festival also does not warrant that the functions or informational materials contained in or accessed or downloaded through our Sites are free of computer viruses or other harmful components. 10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Bulgaria without giving effect to conflicts of law principles that would result in the application of the laws of another jurisdiction.
The parties irrevocably agree to submit to the courts of the Republic of Bulgaria which shall have exclusive jurisdiction to settle any disputes which may arise out of, under or in connection with these Terms and Conditions.
11. Waivers
The Festival’s failure to enforce any of the provisions of these Terms and Conditions does not constitute and shall not be construed as a waiver of any provision or right of Diagonals Literary Festival.
Class Action Waiver
BY USING THESE SERVICES, YOU ARE ENTERING INTO THIS AGREEMENT AND WAIVING YOUR RIGHT TO FILE, JOIN, OPT-INTO, CONSENT TO, INTERVENE IN, OR OTHERWISE BECOME A PARTY IN ANY COURT CASE OR ARBITRATION THAT IS BROUGHT OR MAINTAINED ON A CLASS, COLLECTIVE, REPRESENTATIVE, OR AGGREGATE BASIS. YOU MAY BRING LEGAL CLAIMS AGAINST THE ATLANTIC ONLY IN YOUR INDIVIDUAL CAPACITY (NON-CLASS, NON-COLLECTIVE, NON-REPRESENTATIVE, AND NON-AGGREGATE BASIS), AND YOU MAY NOT PARTICIPATE IN ANY JOINED OR CONSOLIDATED CLAIMS.

“Diagonals Literary Festival,” “the/our Festival,” “the/our Company,” “us” and “we” (capitalized or not) mean the company, DIAGONAL 9 Ltd. (in Bulgarian: ДИАГОНАЛ 9 ЕООД), registered in Bulgaria, European Union, with company number 208401730, and are used interchangeably throughout this text.
The/Our “Site” or “Website” (capitalized or not) mean www.diagonalsliteraryfestival.com.
The/Our “Content” means the posts and pages of the website, excluding information posted or uploaded by a user of the website.
“Your Content” means the work and all accompanying information you submit using one of the official submission forms on www.diagonalsliteraryfestival.com.
The/Our “Service” or “Services” mean all the services and products that Diagonals Literary Festival offers.
“You” and “Your” (capitalized or not) means any user of the website, content or services, whether acting as an individual or on behalf of an entity, including you and all persons, entities or digital engines of any kind that mine, crawl, scrape, harvest, spider, index or collect digital content by a manual or automated process or otherwise.
